AGREEMENT FOR PHOTOGRAPHY SERVICES

The purpose of this agreement is to inform you on what to expect from your photography session. Please read all information carefully. Please note that clauses can be altered to tailored this contract to your needs. If you have any questions, please let me know before the session.

Rie Stella specialises in lifestyle or documentary photography, using almost exclusively natural light; this includes candid and un-posed portraits. My main goal for the session will be, for you to be comfortable and enjoy yourself, in a friendly and relaxed environment.

DEPOSIT AND QUOTES

The deposit is not refundable if the client cancels or changes the engagement. If the photographer fails to appear at the place and time specified above without informing the client at least 24 hours in advance, the deposit shall be refunded to the client.

Fees quoted by the photographer are for the original job description as presented by the client. Any subsequent changes, whether made orally or in writing, may result in additional charges. Presented expenses are estimates. Actual expenses, which may be greater or less, will be invoiced.

If a shoot runs over time by 30 minutes or more, additional time will be billed at the hourly rate for the selected package.

Quotes are valid for 28 days, after which, are subject to change so long as a deposit has not been made.

PAYMENT TERMS
Full payment of the session fee will be required within 30 days of invoice. Late payments will be billed a $20.00 per month handling fee and 1.5% per month interest. If estimated expenses exceed $500.00, the client will pay in advance.

COPYRIGHT AND USE OF IMAGES
Rie Stella retains copyright in the photographs, and hereby grants the client unlimited but non-exclusive rights to use or reproduce the photographs for which the client pays. Rie Stella reserves the right to use the images and/or reproductions for display, publication (print and online) or other marketing/promotional related purposes.

The fees paid to Rie Stella allows you to use the images purchased (both digital and in print) for personal use only. Unless agreed upon otherwise, and with an additional fee, under no circumstances can a client use these images for profit, commercial endeavours, or any other purpose outside the express terms of this agreement. Images also may not be altered or copied without express consent of Rie Stella.

By booking a session, you are giving permission for all attendees of the photo session to be photographed and the images used for the purposes outlined in the agreement.

CANCELLATIONS OR POSTPONEMENTS
In the event of a cancellation or postponement of a shoot by the client or photo subject, expenses incurred by Rie Stella up to the time of the cancellation shall be reimbursed to the photographer. If a shoot is cancelled within 24 hours of departure for the shoot, the client will be billed 50% of the anticipated photographic fee and 100% of the anticipated fees of any subcontractors booked for the job.

In the event the photographer cannot perform this Agreement due to any casualty, technical malfunction, illness, act of nature the client may elect to re-schedule or have the deposit fee or any other fee already paid refunded in full and the photographer / Rie Stella shall have no further liability with respect to the Agreement.

If a session has to be cancelled due to the weather conditions, a new session will be re-scheduled within 3 weeks of the date originally booked.

ASSISTANCE
The client shall assist and cooperate with the photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed; taking time to pose for photographs at the photographer’s direction; providing a person to guide the photographer to desired persons and/or scenes; pre-shoot consultations, etc. The photographer shall not be responsible for photographs not taken as a result of the client’s failure to provide reasonable assistance or cooperation.

DELIVERY
Depending on selected package, within 1-7 days of the session, your edited images will be uploaded to a password protected online gallery. This gallery will remain live for two weeks to give you time to proof. Once your favourites have been selected, your images will receive further editing and retouching. The final images will be delivered in JPG format, either via a Google Drive link or WeTransfer, and will remain active for up to a month.

BACKUP, ARCHIVAL OR LOSS
The photographer will not be responsible for the archival or loss of the photographs, once the final delivery has been made to the client. In the event where the photographs are lost before the final delivery is made to the client, a full refund will be made to the client.

INDEMNIFICATION
The client hereby indemnifies and holds Rie Stella harmless against any and all liabilities, claims, and expenses, including reasonable attorney’s fees, arising from client’s use of their work. Rie Stella also indemnifies and holds the client harmless against any and all liabilities, claims, and expenses, including reasonable attorney’s fees, arising from the photographer’s negligence.
